COURSE DESCRIPTION

The advent of the Internet and the emergence of network professions and professionalism has also led to the emergence of new contractual models; from the hosting contract to those for the creation and management of websites, up to those aimed at regulating new figures such as, for example, social media managers.

The schemes used for the contracts are the traditional ones made available by the Civil Code, but the peculiarity of the matter and the implications of some aspects that are not only those of the relationship in its essence, but go beyond and touch the interests of third parties: from the lawfulness of the contents and relationships with hosting and providers, up to the management of personal data of users.

Unfortunately, there is a great deal of inattention on the contents of the contracts on many sides, starting with the fact that, in not a few concrete cases, the interests inferred by the parties may be legally in conflict; Suffice it to say that often the customer requires a performance of results (visibility of a site and increase in contacts and turnover), while the supplier can only offer obligations of means and certainly does not guarantee certain results.

Furthermore, there are not a few cases in which a contractual relationship is considered “concluded” only following the exchange of a few emails or with the acceptance of a quote in which not even the indispensable clauses to govern the relationship are included.

Hence the need for a course on network contracts, aimed at all those who work in the various sectors of IT, media, social networks and all related activities.

In fact, a contract is not only the moment in which the parties conclude an agreement, but it is also the next phase that ends only when both parties have performed the required services and clauses of guarantees, liability and anything else provided for by the law or agreement.
